Magistrate convict an unregistered person of a criminal offence for performing architectural work without registration.
Johannesburg - Mr. Nkosinathi Mzozo was convicted by the Palm Ridge Magistrate’s Court in Ekurhuleni on 20 March 2024 for performing architectural work without being registered with SACAP. |
Mr. Mzozo was registered with SACAP as a candidate architectural technologist until 2018. His registration was subsequently cancelled due to failure to pay annual fees. The State Prosecutor maintained that Mr. Mzozo committed a serious offence. He previously worked as a registered architectural candidate; therefore, he was well aware of the legal requirements in the architectural profession, yet he failed to comply with them.
Mr. Mzozo was fined double the Rand value he charged a member of the public to do the work, with 80% of that money suspended for five years on condition that he is not convicted of the same offence during the suspension period.
This
finding sends a strong message to the public and unregistered persons that
registration is a prerequisite to perform architectural work. Any deviation
from section 18 (2) of the Act will results in a criminal record.

The South African Council for the Architectural Profession (SACAP) is legally charged to regulate the architectural profession in South Africa by the Architectural Profession Act 2000, Act 44 of 2000.
